We are a tool provider only. We do not sell leads, guarantee accuracy, or endorse any particular use of the data.
2. User Responsibilities
By using Keiste.com, you agree:
- To use the platform for lawful business-to-business (B2B) purposes only
- Not to use our services for spam, harassment, or illegal telemarketing
- To comply with all applicable laws and regulations, including:
- GDPR (EU)
- ePrivacy Directive (EU)
- Data Protection Acts (Ireland)
- Any relevant telemarketing or contact laws in your jurisdiction
You are solely responsible for:
- How you use the business data retrieved from our platform
- The legality of your outreach campaigns or communications
- Ensuring that calls and messages are made with proper lawful basis or consent where required
3. No Endorsement or Guarantee
Keiste does not verify, guarantee, or endorse:
- The accuracy, currency, or completeness of scraped business data
- That the businesses listed have consented to be contacted
- That using our platform will lead to any commercial benefit
You understand and accept that use of our platform is entirely at your own risk.
4. No Liability for User Conduct or Misuse
Keiste.com acts as a software provider and does not monitor, review, or control how users interact with scraped data or who they contact.
By agreeing to these Terms, you acknowledge that:
- We do not monitor, intercept, or store call content
- We are not liable for any outcomes resulting from your calls, campaigns, or communications
- You release and hold harmless Keiste.com and its owners, staff, and partners from any claims, damages, legal actions, or regulatory investigations resulting from your use or misuse of our platform
This includes, but is not limited to:
- Violations of marketing laws
- Complaints of harassment, spam, or improper data use
- Fines or sanctions imposed by regulators (e.g., Data Protection Commission, ComReg, etc.)
5. Call Infrastructure & Third-Party Tools
All outbound calls are made through Twilio, an independent third-party service provider. You agree that:
- Your use of Twilio is subject to their Terms of Service and Privacy Policy
- Keiste is not responsible for Twilio’s performance, uptime, fees, or data handling
- You remain responsible for compliance with applicable call recording, data privacy, and communications laws
6. Account Security
You are responsible for maintaining the confidentiality of your login credentials. You agree not to share your account or allow others to access Keiste.com through your credentials.
We may suspend or terminate your access if you breach these Terms or use the platform in a harmful or illegal manner.
7. Payments and Refunds
Call credit purchases are non-refundable unless legally required. We may offer goodwill refunds or credits at our sole discretion.
You are responsible for monitoring your call credit usage and topping up as needed.
8. Intellectual Property
All software, branding, website design, and content (excluding third-party data) are owned by or licensed to Keiste. You may not copy, reverse-engineer, or resell our tools or platform.
9. Termination
We reserve the right to suspend or terminate your account at any time for:
- Breach of these Terms
- Unlawful or unethical activity
- Excessive complaints or reports from recipients
Termination may occur with or without notice.
10. Limitation of Liability
To the fullest extent permitted by law:
- We provide our services “as is” and “as available” with no warranties
- We shall not be liable for any direct, indirect, incidental, or consequential damages, including loss of profits, goodwill, data, or business reputation
- Our total liability, if any, shall not exceed the amount paid by you in the 30 days prior to the claim

13. Governing Law and Jurisdiction
These Terms are governed by the laws of Ireland and the European Union. You agree that any disputes will be resolved exclusively in the courts of Cork, Ireland.
